d\u2019un commun accord de rompre le contrat de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e qui les lie et fixent ensemble les conditions de cette rupture<\/b>.<\/p><p>La rupture conventionnelle est exclusive du licenciement et de la d\u00e9mission. Ainsi, aucune r\u00e8gle r\u00e9gissant le licenciement ou la d\u00e9mission n\u2019est applicable \u00e0 la rupture conventionnelle du contrat de salari\u00e9 et l\u2019employeur s\u2019accordent sur le principe de la rupture, sur ses modalit\u00e9s et les diff\u00e9rentes difficult\u00e9s qu\u2019elle soul\u00e8ve<\/b>.<br \/>Il est \u00e9tabli en <b>deux exemplaires<\/b>, dont un est envoy\u00e9 \u00e0 l\u2019autorit\u00e9 administrative, <b>l\u2019Inspection du travail<\/b>.<br \/>La convention de rupture doit \u00eatre obligatoirement sign\u00e9e par l\u2019employeur et le salari\u00e9, afin de mat\u00e9rialiser leur accord commun sur la rupture du contrat et ses cons\u00e9quences.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eb3ecc4 elementor-widget elementor-widget-heading\" data-id=\"eb3ecc4\" <b>calendaires<\/b>.<br \/>Lorsqu\u2019il y a r\u00e9traction, celle-ci n\u2019a pas \u00e0 \u00eatre motiv\u00e9e mais elle doit \u00eatre formalis\u00e9e par courrier (RAR ou remis en main propre contre d\u00e9charge, par mail).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9823561 elementor-widget elementor-widget-heading\"
